Landlord & Tenant Law applies to both residential and commercial property and can be a complex area of law that is strewn with rights and obligations for both the landlord and the tenant.

For example, in commercial leases, a long lease may create certain rights of renewal for a tenant, however, such a lease is generally fully repairing and insuring. These leases can contain extremely onerous clauses if not carefully negotiated on behalf of a tenant.

 

From a landlord’s perspective, the benefit of such a long lease must be weighed against the granting of renewal rights and also against tax considerations. Therefore it is essential that both the landlord and the tenant are fully advised of the rights and obligations being created before entering into any binding legal agreement.
